The Tower Defense Facebook page, noplacitastower.org, GoFundMe attorney fee donations and miscellaneous expense donations are for opposing construction of a communications tower at NM-165 and Tierra Madre Road. The effort to stop this construction is a grassroots effort by local residents opposed to the tower and has been organized by Placitas resident Ed Garner. Ed has been consulting with some law trained members of the community and hired an attorney whose experience in Sandoval County land use matters will be critical to our grassroots effort.
There are at least 100 of us involved in this effort and the lawyer cannot represent so many individuals nor everyone who is willing to contribute. Such would delay and ultimately compromise the goal. This is primarily because of a legal concept known as the attorney client privilege that protects communications with the attorney. The attorney will be providing critical strategic advice which we do not want the tower proponents to know about. If someone shares the information the attorney provides it compromises the protections the communications are afforded by the attorney client privilege. We do not want this information to end up in the tower proponents’ hands and thus diminish our efforts.
As a result Ed and two or three other individuals he selects will be the clients with whom the attorney will consult. The information obtained will be used to guide further efforts to defeat the tower’s construction. Information that can be shared with others will be provided if and when possible.
By donating to help pay for the attorney retained by Ed you are agreeing to this arrangement and understand that the attorney’s communications and legal advice may not be shared with you and that all efforts being made may not stop the tower’s construction. Also by donating now you are not committing or in any way obligated to donate any further monies. This Explanation and Agreement is merely to inform you about the legal representation arrangement.
